Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and GoldenEye Engineering LLC ("Company," "we," "us," or "our"), governing your access to and use of TimOS (the "Service"), including our website at timos.app, mobile applications, APIs, and all related services.

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. Description of Service

TimOS is a personal operating system platform that enables users to:

  • Create and manage personal journals and daily logs
  • Track pillars, goals, and personal insights
  • Receive AI-powered analysis and recommendations
  • Export and manage their personal data

2. Eligibility

To use the Service, you must:

  • Be at least 18 years of age, or the age of legal majority in your jurisdiction
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under applicable laws
  • Not have been previously suspended or removed from the Service

3. Account Registration

3.1 Account Creation

To access certain features of the Service, you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials. We recommend:

  • Using a strong, unique password
  • Enabling multi-factor authentication (required)
  • Not sharing your account with others
  • Logging out from shared devices

4. Subscription Plans and Payment

The Service offers both free and paid subscription plans. Features, limitations, and pricing for each plan are described on our pricing page. For paid subscriptions:

  • Payment is due at the beginning of each billing period
  • Subscriptions automatically renew unless cancelled
  • Prices are listed in USD and exclude applicable taxes
  • We use Stripe to process payments securely

5. Your Content

You retain all rights to the content you create using the Service. By using the Service, you grant us a limited license to store and process your content solely to provide the Service to you. We do not:

  • Sell your content to third parties
  • Use your content for advertising
  • Train AI models on your personal data without explicit consent
  • Share your content except as required by law or with your consent

6. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal information. Key points:

  • All user content is encrypted using AES-256-GCM encryption
  • We use envelope encryption with per-user keys
  • Deleting your account permanently destroys your encryption keys (crypto-shredding)
  • We comply with GDPR, CCPA, and other applicable privacy laws

7. Termination

You may terminate your account at any time through your account settings. We may suspend or terminate your account if you violate these Terms. Upon termination:

  • You will lose access to your account and content
  • Your encryption keys will be destroyed after 30 days
  • You may export your data before termination

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
